How do I file a DMCA counter-claim notice?

If you believe you have received an invalid DMCA/copyright complaint, you have the right to submit a DMCA counter-notice.

  • You must be willing to state under penalty of perjury that you have a good faith belief the reported content should not be removed.
  • Filing a counter-notice could result in legal action from the complaining party. It is common practice to consult with legal counsel before filing.

A valid DMCA counter-notice must include:

  1. Your physical or electronic signature
  2. Your name, physical mailing address, and valid phone number
  3. Identification and location (URL) of the material involved in the complaint
  4. A statement that you believe the counter-notice is accurate and valid under penalty of perjury
  5. Your consent to the jurisdiction of a federal court where you reside (if in the United States), or where the content is hosted

Once a counter-notice is filed, any further communication regarding the complaint must be handled between you and the complaining party directly. Hawk Host will not make itself liable for potential legal action as part of a counter-claim.

If necessary, we may need to remove the infringing domain(s) from our network or disable access. In that case, we will provide a backup of your account or the opportunity to remove only the infringing domain(s) while continuing to host other services.
